Selling a Property With Tenants

Tenants have rights that stay in place when a property is sold. Roger helps landlords choose the right approach and market the home to the right buyers.

Your main options

  • Sell to an investor who keeps the tenants. Leases and rent amounts carry over to the buyer.
  • Sell to a buyer who will live there. In some cases the buyer can ask the landlord to serve notice to end the tenancy for their own use. The Residential Tenancies Act sets strict notice and compensation rules.
  • Reach a voluntary agreement with the tenant. Get legal advice before you do.

Showings with tenants

Landlords must give tenants proper written notice before entering for showings. Clear, respectful communication with the tenant makes the whole sale go better.

This page is general information, not legal advice. Talk to a paralegal or lawyer and see the Landlord and Tenant Board for current rules.

Questions People Ask

Can I sell my rental property with tenants living in it?
Yes. The tenancy continues with the new owner unless it is ended properly under the Residential Tenancies Act.
